How Often Cal/OSHA Citations Are Appealed, and How Long They Take to Become Final

Cal/OSHA publishes no statistics on how often its citations are appealed or how long an appeal takes to resolve. This page is CompliantCA’s computation of both from the federal enforcement data. Appeal rates cover the 159,203 Cal/OSHA citations issued from 2016 through 2025. Appeal durations cover citations issued 2016 through 2023. How often citations are appealed

Labor Code §6600 gives an employer 15 working days from receipt of a citation to appeal to the Occupational Safety and Health Appeals Board. The enforcement dataset records the date an appeal was docketed against each citation. For citations issued 2016 through 2025:

Half of all Cal/OSHA citations issued 2016 through 2025 were appealed. General violations were appealed least, at 44.4%. Serious citations were appealed at nearly three in four, and willful citations — 158 of 183 — almost always.

These counts include citations that were later deleted from the record, because deletion is frequently what an appeal produces: 91.3% of the window’s 8,435 deleted citations had been appealed. Deletion and reduction rates themselves are their own analysis.

Counted by inspection rather than individual citation, the rate is similar: 45.5% of the 48,526 cited Cal/OSHA inspections in the window had at least one appealed citation.

How long until a citation becomes final

Under Labor Code §6601, a citation that is not appealed within the 15-working-day window becomes a final order of the appeals board, not subject to review. This section measures the appealed citations issued 2016 through 2023: how long from issuance to final order.

Appealed citations took a median of 236 days from issuance to final order. A quarter resolved within 118 days; a quarter took longer than 497. The full distribution:

Measured from the day the inspection opened rather than the day the citation was issued, an appealed citation’s full sequence ran a median of 365 days. The issuance step alone — inspection opening to citation — has its own timing analysis.

How penalties moved, by appeal status

This table keeps a stricter window — citations issued 2016 through 2020 — because a penalty keeps changing until its case fully settles. Average penalties per citation, as issued and as they ended, excluding deleted rows:

The two rows for each class describe different sets of citations, not the effect of appealing. Appealed citations start larger in every class — appealed serious citations averaged $9,294 at issuance against $6,742 unappealed — so the gap between the reduction columns measures which citations get appealed as much as what appealing did. Penalties on unappealed citations also move: unappealed serious citations ended 15.3% below their issued amount on average. Methodology

CompliantCA computed this analysis from the U.S. Department of Labor enforcement dataset (the OSHA Information System), which includes Cal/OSHA because California operates an OSHA-approved State Plan; the bulk export was retrieved 2026-08-30. Scope: citations on California inspections. Federal OSHA’s own California inspections (5,568 citations in the 2016–2025 window) are excluded, because their citations are not appealed to the California appeals board. “Appealed” means the citation carries a docketed-appeal date in the dataset (the “contest_date” field); the dataset records that an appeal was docketed and when — not who filed it, what it argued, or how it was resolved, and it does not distinguish employer appeals from the rarer employee contests of abatement periods.

Each section states its own issuance window because each statistic completes on its own clock. Appeal rates use 2016–2025: appeals are docketed a median of 24 days after issuance, so every year’s rate is complete. Duration figures use 2016–2023; appeals still open at retrieval are included and assigned to the over-2-years bucket. That assignment is exact rather than approximate: every open appeal in the window had run at least 976 days by the retrieval date, so its bucket — and its rank above every published percentile — is already certain. The penalty table uses 2016–2020, old enough that those cases have settled; its “final” amounts are the penalties as they stand after appeals and settlements, as of the retrieval date.

Appeal-rate statistics include citations flagged deleted in the source, since an appeal that ends in deletion is still an appeal; timing and penalty statistics exclude them. Counts are per violation line item — the dataset’s unit, which this page calls a citation — except where the text says inspections. 178 citations whose recorded appeal date precedes their issuance date are excluded from timing figures as data noise.
